Dismissal; Proper advice saves money. Before any employee’s employment is ended the employer should follow certain procedures. This is wise even if the employee has only been employed for a short time. If the employee has been employed for over a year such procedures are vital. The process includes the statutory dispute resolution procedures which lay down minimum standards. These standards give employees the right to be informed in writing about any accusations, a hearing accompanied by a representative from a defined group of people and a right of appeal. Additionally employers must meet a reasonable and fair standard of conduct taking account of their size and resources etc. Failure to follow the right procedures in any dismissal can lead to an automatic unfair dismissal and increase of compensation by between 10% and 50%. And don’t forget to deal with grievances in accordance with the statutory procedures. That includes grievances even after an employee has left their job. |
